Terms of Service

These terms are written in plain language, for transparency rather than for lawyers. They are meant to be read, not skimmed past. If any part is unclear, or you disagree with something in it, write to info@thecigarguys.com.

1. Accepting these terms

The Cigar Scanner is operated by The Cigar Guys, referred to here as “we” and “us”. By using the app or this website you agree to these terms. If you do not agree with them, please do not use the service. Our Privacy Policy forms part of this agreement.

2. Who may use it

The Cigar Scanner is a photo-identification tool. It does not sell tobacco, does not promote smoking, and is not affiliated with any manufacturer or retailer. You need an account only if you want your scans saved; scanning itself is free and works without one. You are responsible for using the service lawfully where you are.

3. What the service is — and what it is not

The Cigar Scanner is a free photo-identification and personal-collection tool. You photograph a cigar band, the scanner works out what the cigar is, and the result is saved to your own scan history. From that history the app builds a flavor palate wheel, and a separate feature helps you find cigar lounges near you on a map. It does not sell tobacco, does not promote smoking, and is not affiliated with any manufacturer or retailer.

It is important to be clear about what it is not:

  • Identifications are automated estimates and can be wrong. Bands are similar, counterfeits exist, photos are imperfect. Treat every result as a good guess, not a fact.
  • Flavor profiles are estimates of what a cigar is generally said to taste like. They are not a review, and they are not your palate.
  • It is not an authentication service. A result here is no evidence that a cigar is genuine.
  • It is not a valuation or appraisal service. Do not rely on it when buying, selling, insuring or trading.
  • It is not medical, health, legal or professional advice of any kind. Tobacco use carries serious health risks, and nothing in this app should be read as encouraging it.
  • Lounge results come from public map data contributed by others. We do not verify that a place exists, is open, or allows smoking.

4. Your account

You can start scanning without registering; the app creates an anonymous account so your scans have somewhere to live, and signing up later upgrades that same account. Keep your sign-in credentials to yourself. You are responsible for what happens under your account, and you should tell us promptly if you think someone else has access to it. We may suspend or close an account that breaks these terms.

Your photos remain yours. To run the service, you grant us a non-exclusive, worldwide, royalty-free license to store, process and transmit the images you submit — including sending them to the service providers described in the Privacy Policy — for the purpose of identifying the cigar, saving it to your history and operating the app. That license ends for a given photo when you delete it, apart from the anonymized derivatives described in the Privacy Policy.

Corrections are different, and worth stating plainly: when you tell us an identification was wrong and supply the right answer, that correction and its notes go into a shared community catalog and may be used to improve identification for all users, without attribution or compensation. Do not put anything private in a correction.

7. Intellectual property and trademarks

The app, this site, its design and its code belong to The Cigar Guys. Cigar brand names, logos, band artwork and product names belong to their respective owners. We use them only to describe and identify the cigars you photograph — nominative use — and that use implies no affiliation, sponsorship or endorsement in either direction. If you own a mark and object to how it appears here, email us and we will address it.

8. Third-party services

The service depends on outside infrastructure providers, described by category in the Privacy Policy. We do not control them, we are not responsible for their content or availability, and their own terms may apply to you when you use those parts of the app.

9. A free service, offered as is

The Cigar Scanner is free. There is no uptime guarantee, no support commitment and no service level of any kind. We may add, change, limit or discontinue any feature — or the whole service — at any time. Where we can reasonably give notice before removing something you rely on, we will. Export or delete anything you care about while it is still there.

10. Disclaimer of warranties

The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that identifications will be accurate, complete, or that the service will be uninterrupted or error-free. Some jurisdictions do not allow certain warranties to be excluded, so parts of this may not apply to you.

11. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost data, lost profits, or losses arising from decisions you made in reliance on an identification, a flavor estimate or a lounge listing. Because the service is free, our total liability to you for any claim is limited to one hundred US dollars.

12. Indemnity

You agree to indemnify and hold us harmless against claims, damages and reasonable legal costs arising from your misuse of the service, your breach of these terms, or content you submitted that you did not have the right to submit.

13. Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules, and the courts located there have exclusive jurisdiction over any dispute. If a provision of these terms is held unenforceable, the rest stays in force.

14. Changes to these terms

We may update these terms as the app changes, and the date at the top will reflect the latest version. For material changes we will give notice in the app. Continuing to use the service after a change means you accept the revised terms; if you do not, stop using it and delete your account.
